Relevant Legislation: Part 3A of the Environmental Planning and Assessment Act 1979 (EP&A Act) and State Environmental Planning Policy (Major Projects) 2005. When granting approval for the concept plan for the former Carlton United Breweries (CUB) site (MP 06_0171), the Minister for Planning determined, pursuant to section 75P(1)(a) of the EP&A Act that approval to carry out the project or stages of the project with a capital investment value of $5 million or more, is subject to Part 3A of the EP&A Act. The capital investment value of the project that is the subject of this Environmental Assessment is $10 million. Accordingly, Part 3A of the EP&A Act applies to the proposal
